Gyamchund Shaw
v
Mahommed Cauzim Alli Khan.
This Cause begun yesterday was continued to day. After some progress in the cause, a Witness for the Plaintiff on a Persian bond for thirteen Thousand Rupees being produced to him, swore that it was the Seal of the Defendant, although the Witness could not read Persian, in which Language the Seal was. He swore that he was sent by the Plaintiff to the Defendant with the Paper now produced, and saw the Plaintiff put his Seal to it. This he swore, though he had put no mark on, the Paper, nor could read it.
The Court were clearly of opinion that this Witness was guilty of Perjury: and he was therefore, by Impey’s direction, with the consent of Chambers and myself, committed to Prison, for the contempt of committing Perjury in Open Court. This I approve
