and have no doubt that it was right. But I hold it utterly inconsistent with the Doctrine of Impey and Chambers, that we are not a Court out of Term as well as in for though the Charter provides for Sitting fourteen days beyond the Term, yet it does not make us then a Court, more than at all times. And I think this is a commitment, by the Court, If then the Court can do an act of such consequence as to commit for a contempt; Why are we not a Court to all purposes? Why are we not for the appointment of an Officer?
