1778. Sittings. [Thursday] Feb. 12.
not blow hot and cold. We determined on Tuesday, that in cases where it was necessary, and the proper course of conveyance in that place, to have a Pottah, we would not admit any other title: As I said then, so I say now, you must go and get a Pottah.
Chambers assented to this, and we all agreed that in the present case the Plaintiff must be non-suited.
We all agreed that as a General Rule it was right to expect the Pottahs to be produced, but we also all agreed, that there might be cases not provided for in this General Rule, where the Evidence of title would be good, without a Pottah, among which Impey instanced the Case of a title under an execution of this Court, and said he could instance many others.
