Indictment had been found, yet Mr. Williams who was bound by Recognizance to Prosecute, had no notice that he would surrender, nor had Mr. Williams appeared to Prosecute, but as it was said was absent at Maulda about Three Hundred Miles from Fort William, the Court would not therefore then proceed to the Trial.
