to be discharged from this Indictment, and from their Imprisonment on it, and the Prisoners being soldiers it was directed they should be deliver’d to an officer who brought them from Cawnpore to carry them back again thither.
The determination on which this Indictment was Quashed, is directly contrary to many Judgments in this Court.
