and Mr. Justice Hyde both agreed in conversation between themselves, that it would be very desirable the Legislature in England should make an Act declaring wat Offences here should be capital, and how other Offences should be punish’d.
I do not consider this Judgment of Quashing the present Indictment as determining what in future shall be done on Indictments for such offences, but
