On a Motion for Costs for not going on to Trial in a Cause wherein Rampersaud Chatterjee is Plaintiff, Mr. Staples who we know is sometimes Mad, and is so now, we order’d that the Costs should be paid by Mr. Staples unless cause shewn in four days, because there being reason to suppose it was by incapacity that the Cause was not tried, we thought it had that the Plaintiff should be charged with the Costs for what is most probably not his fault in any degree but intirely the fault or misfortune of his Attorney, and we meant to put Staples to the proof that it was not his fault.
