Mr. Newman, moved that the Plea to the Jurisdiction in this Cause might be dissallow’d, and that thereon the Plaintiff might have process against the Defendant to compel him to answer. This he grounded on a Rule which said that several sorts of Pleas and among them, pleas to the Jurisdiction, should be disallow’d if they were not enter’d with the Register within so many days, these Pleas should be disallow’d of Course: But on looking into the Rule, it appear’d that it had been alter’d and the Pleas were now directed to be enter’d with the Sworn Clerk, and notice to be given to the opposite Sworn Clerk: and in this alteration it was not said that the
