had recover’d in some suit against a Gomastah of Mr. Keighley’s, for whom Bindabun was security, he being recommended by Bindabun and employ’d under him; the Balance of the account being therefore so much in Mr. Keighley’ favour, Mr. Newman said, it would be contrary to Equity to oblige Mr. Keighley to pay the bond debts, and to seek a remedy to recover back again that money and 31,701 Rupees more, which are due to him: and by many actions depending in Court it is known, that the Estate of Bindabun is insolvent.
Mr. Keighley annexed an account to his affidavit, in which he gave credit for all the four bonds, against which he Prays injunctions, and also for a fifth bond, against which by Mistake of his advocate no Injunction is Prayed: and likewise for a Sixth Bond, for thirty Thousand Rupees, which has not yet been put in suit, but which is mention’d in One of the affidavits, made on the part of Chowdranny, to shew that no Injunction, ought to be Issued.
