There were several other motions, and among the rest One to shew cause why a Cause should not be put off until next Term, for the absence of a material Witness: this my brother Chambers doubted about granting, because, this being the last day of the Term, there was no time in the Term when cause could be shewn, and he doubted whether cause could be shewn, or the Rule, could be made absolute at the Sittings. I said, consistent with what had been the Doctrine [meaning in the case of Mr. Uvedale, mention’d before in my Note Books] I had formerly doubted, whether at the Sittings we could hear a motion to put off a Trial, and that I had desired, on such a Motion being made when I was alone in Court, that it might be put off for a few minutes untill One of my brethren came, and that on either the Cheif Justice or my brother Chambers coming into Court the Motion had been repeated and granted; and he had said, the Court was certainly compe =
