at Law, the Money should be forth coming, to satisfy the Judgments; but in the present case; the rule for an Injunction untill answer and further order; was made absolute, without putting those Terms on Mr. Keighley because, according to his affidavit, his title to releif against those Judgments seem’d very clear.
Mr. Keighley, by the affidavits made on the side of Chowdranny was charged with having on the Death of Bindabun possess’d himself of all his accounts and Papers, and of course, among the rest, of his own bonds to Bindabun, and particularly, of One for Thirty Thousand Rupees, which the Deponent swore he saw Executed, and now on Search could not find. Mr. Keighley swore he never took any of his Papers or Books of any kind. And as to this bond of Thirty Thousand Rupees, Mr. Keighley fully exculpated himself in my opinion, by giving credit for that Sum in his account provided the State of his account in other respects
