1778. 4 Term. [Tuesday] Nov. 17.

Bussint Roy had Sold this House to Cundreb Doss about three years before the Confession of the Judgment and had deliver’d the Possession to Cundreb Doss: that is, Bussint Roy had agreed to sell the House in Question to Cundreb Doss for 7500 Rupees, and at the time of the Agreement he had received 2000 Rupees part of the Purchase-Money and had put Cundreb Doss into possession immediately and had afterward and before the Judgment which Bussint Roy confessed to Nemychurn Mullick, been satisfied the rest of the Purchase Money, by deducting several Sums at different times, and writing them in the account as paid by Bussint to Cundreb, in part of a Balance due from Bussint to Cundreb on a Salt account, Bussint had acknowledged himself satisfied in that manner, and had promised to deliver the Pottah and the Bill of Sale which he had from Ramtono, and to make a New Bill of Sale from himself to Cundreb Doss.
Impey, not having been present at the Trial did not give any Opinion in this
cause.
