Impey. This confinement was proved to have been in the House of the Defendant and if it was by Order of his Master it was an unlawful act, and all who are active in it are liable. It is a Slight case, but the Court think he ought to recover Costs, and therefore as in England Forty Shillings Dammages intitle the Plaintiff to Costs, we think proper to give thirty Sicca Rupees, which some what exceed that Sum.
