We were therefore of Opinion, that this Imprisonment might have been justified on a proper Plea, and therefore, though we were obliged to give Judgment for the Plaintiff, we gave only

This was an Ejectment, for a House and Ground call’d the Cutwally in Calcutta.
It had come on for Trial once before, that is another Ejectment for the same Cause, Ground, and the Plaintiff was non-suited by the Judgment of the Court then consisting of Sir Robert Chambers and myself, because he produced no Pottah which is a Bengal Conveyance, but only a Certificate by the President and Council of a Sale by the Company’s Vendue Master. Now they came prepared with a Pottah
