An Action of Trespass, Assault and Faulse Imprisonment. The Defendant was Fowzdar of Houghley, and the Plaintiff was his Dewan. The Plaintiff proved the imprisonment and making him sign an account in which he charged himself with Considerable Sums which he said had been given to himself as presents by the Zemindars on occasion of Hindoo Festivals, which kind of Presents were call’d.
There was only the Plea of Not Guilty, and no Justification.
It appear’d the Cause of the Imprisonment was the Plaintiff’s having received Presents from the Zemindars, which as Impey remark’d was criminal, and directly contrary to the Act of 13th G. 3d. ch. 63, prohibiting
