The Plaintiff fail’d in proving demand and refusal, and therefore there was
A Non-Suit.
The Question meant to have been made in this Cause, was whether, a Delloll, that is a Brother, who has Goods put in his Possession to be sold, and to be paid by a Commission on the Sale, is to be liable for the loss of those Goods, by having them pick’d out of his Pocket, but no decision was made on that Question.
