1777. Sessions. [Monday] Dec. 8th

I had a large investment of my own on board.
He was ask'd by Impey whether he had any Witnesses. He said no. He was ask’d by Impey whether he would call Witnesses to his character. At first he called on the captain. Impey charged him to be cautious what he did. He then declined asking any question and said the Captain, and almost all his officers were his enemies.
He was acquitted.
The reason was that the Goods were not proved to have been in possession of the Prisoner, and Impey very rightly, summed up strongly in favor of the prisoner, and cautioned the Jury not to attend to any rumors they might have heard, but only to the Evidence
