stated that in paying off a Mortgage which the Defendant intreated the Plaintiff to Lend the Money for the particular purpose of paying off, and in paying other Debts the Defendant desired him to pay, and by paying to the Defendant himself, about Five Thousand Sicca Rupees in Gold Mohurs and also a Note on a Podar for a small sum in Copper Pisa. The Plaintiff also annexed to his affidavit a Bengally account which he swore was signed by the Defendant, in which the Payments were so stated, and two of the three Witnesses whose names were written on the Back of this
