Mr. Justice Hyde. The Court a few days past refused to direct an Issue to try whether a Loan was usurious, in the Case of Mr. Chapman v Moore, Sanders and Lacy, and the Court there determined the Motion on the affidavit of Mr. Chapman denying the usurious Contract, though in that Case the affidavit charging the usury was sworn of Moore and Lacy, and denied by Chapman alone, whereas here the affidavit of Tulseram Ghose is in a great Degree confirm’d by his two Sercars, therefore
