Facts appearing in Evidence.
The Plaintiff was appointed Surgeon to the Vizier on or about the 15. Of April 1782 and Surgeon to the Resident at Lucknow, on the 29 of July 1782, the first appears from Mr. Bruere’s deposition, and as to the latter I conceive it to be tacitly admitted on all sides, that he was Surgeon to the Resident during the whole of Mr. Bristow’s residence and therefore ie is not necessary to consider how far the evidence of that appointment given before the Court Martial can be evident to us.
The Defendant having attended Mr. Bristow and his family and other persons by his direction, did on the 18 of May 1784, send from Lucknow where he was, to Mr. Bristow at Calcutta the bill marked B in appendix to Proceeding of Court Martial the signature to which Mr. Thomas acknowledged before the Court Martial to be his.
That Mr. Thomas was in or before February 1782, appointed Surgeon Major to the first Brigade, is proved by Exhibits Q. and R that he had actually resigned that appointment at the time of sending the said bill on the 18 of May 1784,
