is clear from Exhibit T but that he never joined the Brigade nor was mustered with it is positively proved by Major W. Scott; and that he received no pay as Surgeon Major, the same being retrenched in consequence of an order of the Governor General and Council, appears sufficiently by comparing Mr. Henchman’s deposition with Exhibits O, U, and V.
It is proved partly by Major William Scott who was Secretary to General Stibbert and partly by Colonel P. Murray who was Adjutant General that on the 7 of December 1784, General Stibbert then Commander in Chief received from the Plaintiff Thomas a letter to the purport and effect of Exhibit N. which is a letter requesting the General’s permission to resign his appointment, and desiring him to lay before the Governour General and Council an enclosed application for leave to resign the service.
The enclosed application thus mentioned was a letter to the Governour General and Council, which Colonel Murray, looking at Exhibit A, says was constantly to this effect
