Mr. Bristow being come presented with his own hand & letter to General Stibbert whereby and by a written paper inclosed therein he made the delivery of the bill that I have before mentioned, the subject of an accusation, for which he desired that Thomas might be arrested and brought to a Court Martial.
Exhibit C. admitted by the Defendant’s Advocate, contains the words of the Letter – prout – page 164 of my notes. – and
Exhibit L. proved by Colonel Murray is a copy of the Charge – prout – page 179 of my notes.
The Plaintiff on the same 7 of December was put under arrest, in consequence of that charge, by the Adjutant General acting, as he says, by the order of General Stibbert; and on the 9th of that month General Stibbert sent a letter to the Governour General and Council, which is produced by Mr. Bruere, then Secretary to the board, and proved by Colonel Murray, in which the General encloses a copy of Mr. Bristow’s letter to him, and states (but erroneously as it seems) that Mr. Thomas had desired a Court Martial to meet as soon as possible.
