The questions that arise on this state of Facts are
1. Whether the Plaintiff has received any injury – any hurt which the law ought to redress.
2. Supposing him entitled to redress, whether he can obtain it by this action. and
3. In case he is entitled to Damages what ought to be the amount of them.
The Injury of which he complains of is principally that he has been compelled to answer as a criminal, before a Court Martial, for conduct unbecoming a Gentleman for which if true he was not liable to be tried & punished by that Court or by any other.
