This is an Action on a Bail Bond.
Mr. Brix, Moves on an affidavit of Mr. Honycomb the Attorney in the Cause who swears that Mr. Tolfrey the Attorney for Gorachund undertook on the behalf of Gorachund that Gorachund should pay the Costs, on which this Action and the other two Actions on the same bail bond, had been stricken out of the Paper by Mr. Honeycomb the Plaintiff’s Attorney. This was moved before Mr. Justice Chambers came into Court. Mr. Justice Hyde said, I see no reason why the Plaintiff should be driven to his Action to recover the Costs in this Case, if there is any defence it may be made on the Rule why an Attachment should not Issue to compel the payment of Costs. Take the Rule.
