went beyond what the Court thought proper to grant, for he desired the Injunction might extend to stay proceedings in an Action on the case but this the Court refused, because there was no offer to pay the sum due into Court, and the Sum due, not being ascertain’d, the Court could not direct that Condition to be added, as in the Case of the Action of Debt on the Bond.
An Action on a Bengal Note was tried, and Judgment, for the Plaintiff.
