behind the Bench on which the Advocates sit. The Crib in which the common Prisoners are placed at their arraignment and Trial was on this occasion removed, that Mr. Hare might come to the Bar, which Impey said was the distinction observed in cases of Persons who come in by surrender.
When Mr. Hare was standing at the Bar, Impey said, Mr. Hare “is not surrender’d” and then he directed Mr. Bagshawe who attended instead of Mr. Vanrixtel the Sheriff, and Mr. Harry Stark the Deputy Sheriff, to go down from the Bench where he was sitting to take Mr. Hare into Custody, and Mr. Bagshawe did so, on which Mr. Brix, who attended as Advocate for the Prisoner, said “My Lord, Mr. Hare is surrender’d”
Then Impey bid the Clerk of the Crown proceed, and Mr. Johnson arrain’d the Prisoner.
Mr. Brix. I desire your Lordship’s permission to appear as Councel for Mr. Hare.
