1780. 3 Sittings. Saturday July 15.

Saturday July 15th 1780.
Present
Sir E. Impey
and
Mr. Justice Hyde

[Triple Line]
James Hennis
v
Bowanny Churn Surmono.

[Triple Line]
An Action for Money Lent.
A Bengal Note was produced and proved payable to Mr. John Hinnis, but no decision was made whether this might have supported the action with Evidence that James Hennis was the Man meant, because there was also Evidence of the Defendant’s having acknowledged the actual receipt of the Money, and that was sufficient Evidence to support this action without the Bengal Note, the Councel for the Plaintiff being content to give up the Interest, which if the Note had been right would have been due.
