to administer in that Province which is beyond Bahar, and out of the Jurisdiction of this Court, the Oath required to be made by Persons applying for Administration, of the Value of the Effects of the Deceased, and of the truth of the Facts contain’d in the Petition for Administration, one of which Facts in the Present Case is to be that Mr. Wilson is a Creditor of the Deceased. I think Impey is quite right in Granting this Commission and the like has been done, with my assent three or four times. Yet I think when the Administration is to be granted and the Oath of Administrator is to be Administer’d, Mr. Wilson must be within the Provinces. I think in this Case because the Validity of the Grant of this Administration may possibly be contested.
