Such Bill. So where a Will is provd, and the precedent Administration [ill] , such Bill is usually necessary for the Discovery of the Goods: And yet in Strictness of Law there was a Trespass.
And when this Court can determine the Matter, it shall not be an Hand maid to other Courts nor beget a Suit to be ended elsewhere. And if the Court is fully satisfied, as to the Evidence, they will not send it to a Trial at Law at all.
For an Issue as Law is a f-ignd Issue in an Action upon the Case directed by the Chancery for the better informing and guiding the Concurrence of the Court. And therefore no Issue ought to be directed to try a matter fully provd in the Course.
