piece of Paper – in the first of it was contained the balance due to the Plaintiffs and on the lower part was the objections made by the Defendant’s people the Paper in this state was brought to me by Monick Muckerjee, and the people on behalf of the Plaintiffs and the Defendant.
The result of all was that I desired the Defendant’s people to write down their true objections on the back of the Exhibit No 20, such as they could prove, which they did accordingly, and cut off the bottom part of the paper Exhibit No 20 – After this I desire Neelmoney Miter to produce his proofs respecting his objections which he promised to do. Some days after, Neelmoney Mitter came to me and said that he could not produce the Witnesses to prove his objections, but that he would bring Letters from them if I would accept that as proof – to this I objected and told him I could not believe any Evidence by Letter; I mus have the persons to appear and prove it before eme.
At last it was settled that Neelmoney should waive all these objections upon condition that the Plaintiff’s people would give him an agreement that, in case Neelmoney could prove his objections within a month, he should be allow’d the amount, but otherwise not so much for Exh: No 20.
