“Sealed; and whereas the said Elizabeth Fenwick did some time on or about the fifth Day of July Instant enter a Caveat against granting Administration of the said Estate to the said Alexander Colvin and whereas the said Alexander Colvin hath Proposed to the Constituted attorney of the said Elizabeth Fenwick that if the Caveat so entered by her against Granting Administration in the Goods of the said James Lindsay Ross is with dracon and Administration is Obtained by him that he the said Alexander Colvin will Pay unto the said Elizabeth Fenwick from the Funds of the Estate of the said James Lindsay Ross Deceased the Sum of twenty thousand five hundred sicca Rupees, or whatever Sum shall appear to be due to her upon the said account, upon her Producing an affidavit duly sworn before George Francis Grand Esquire, the Judge of the Dewanny Adaulet at Patna, verifying the said debt. And whereas the said Alexander Colvin hath further agreed to Pay to the said Elizabeth Fenwick the further Sum of Five thousand Sicca Rupees over and above what shall be sworn to be due upon the said account as a further consideration for with drawing the said Caveat such several sums of money to be Paid by the said Alexander Colvin within nine months from the Day the said Caveat shall be so withdrawn and he shall have obtained Letters of administration to the Estate of the said James Lindsay Ross; and whereas the said Elizabeth Fenwick hath agreed to with draw her said Caveat upon the Terms and Conditions aforesaid Now the Condition of this Obligation is Such that if the said Alexander Colvin his heirs Executors or administrators shall within nine months after
