thereof and of every Part thereof by the said Alexander Colvin being Parcel of the said Damage of Fifty thousand Sicca Rupees above Complain of she the said Elizabeth Fenwick ought not to have or maintain her action aforesaid thereof against him the said Alexander Colvin because he says that the said Elizabeth Fenwick hath not, at any time hitherto, Produced affidavit sworn before the said George Francis Grand Esquire the Judge of the said Dewanny adaulet at Patna aforesaid, verifying the said debt of twenty thousand five hundred sicca Rupees, or any Part thereof, so suppose to be due to the said Elizabeth Fenwick, as in the said Condition above specified is mentioned and Contained, whereby the last mentioned supposed Debt or any Part thereof might appear to be really and truly due to the said Elizabeth Fenwick according to the form and Effect of the said Condition, and this he the said Alexander Colvin is ready to verify, wherefore he Prays Judgment if the said Elizabeth Fenwick for the sum of Sicca Rupees Twenty thousand five hundred in the said [ILL] first above mentioned and the supposed Damages for the detention thereof being Parcel of the said Damage of Fifty thousand Sicca Rupees above complained of ought to have or maintain for action aforesaid against him the said Alexander Colvin.
