1778. Sittings. [Wednesday] July 29th.

Title was by descent, it was not in him alone, but in all the Sons.
The Court were of opinion that the Paintiff had sufficiently proved his Title. Therefore there was Judgment for the Plaintiff.
We thought the Title of Nundoo, Lessor of the Plaintiff Doe was continuation of the Possession of Bullram his Father, although there were several Sons, and he was the Second, yet having got a Pottah it must be understood, to operate as compleating a title, which no Person could impeach but his brothers, and to be a good Title against all Persons but them, and the Pottah must relate to the time of his possession which was proved to be from the Death of his Father, and therefore it must be understood that he claimed by descent, and that he possess’d by the assent of his Brothers, and it must be supposed, either that he was a Trustee for his Brothers their several proportions or that it was agreed he should take the whole
