Jeremiah Baker.
Trespass in entering his Close and inclosing part of it with a ditch and Posts and Rails.
Mr. Newman. The intention is to try the right to this Piece of Ground which the Plaintiff says is his.
There was a Wall which divided the ground of Mr. Tiretta, from that of Mr. Baker.
A few months since Mr. Baker sate up an entire new claim to part of Mr. Tiretta’s ground.
In the Plaint the trespass was alledged, to wit, on the 23d of May: the Plaint was filed May 27th 1778.
The first Witness who was a Portuguese said what he knew was in June. The second said the same.
The third the same.
The Plaintiff was non suited.
