Cross Examined.
Oudenarain’ name is down for the Company’s Rent at Murtezagunge who received the rents from Ryots I cannot say. It was generally thought that Birjoo Roy received them, but as Oudenarain’s name is in the Sunnud, I cannot say. As I cannot tell who received the rents, I cannot tell you who paid them into the Cutcherry. For the whole of the Farms held by Oudenarain, which were very extensive, I know there were considerable balances, but if you particularize the farms I cannot tell you which particular farm was in balance. To the best of my recollection Hurry Kissen, upon this balance being incurred upon the general farm, was appointed to attach the whole of it. I believe he was appointed by Mr. Bogle. A [ILL] cannot be appointed by any other but by the Chief, and that appointment must be in writing. I do not conceive Ramcaunt could have appointed him. I do not Oudenarain’s being dismissed to have been an act of the Deft’s at all. I do not know that the Defendant possessed any public authority. He was Mr. Bogle’s private Dewan & therefore I do not conceive that
