1777. Sittings. [Tuesday] Nov. 25.

Plaint especially the first Count, by the omission of some words, which seem’d to have been omitted by the accident, was absolute Non-Sence. There were two other Counts which possibly might have been supported, but the Plaintiff chose rather to withdraw the Cause to amend, and it was agreed by the Defendants’s Council that he should withdraw the Cause without payment of Costs. There was a Notice of Justification, but I did not see it, the Cause not being proceeded on.
