1779. 3 Term. [Tuesday] July 20.
The Defendant had Pleaded Non Guilty, and a Plea to the jurisdiction.
The Witnesses for the Plaintiff proved the Defendant was a Collector and paid the Revenue he collected into the Zillah Committee at Calcutta, which the Court thought (Impey and Hyde only being present) was sufficient to prove him directly or indirectly imploy’d by the Company. Therefore there was Judgment for the Plaintiff in the Plea to the Jurisdiction.
The Witnesses proved only a slight beating on a demand of Revenue which was not proved paid, and therefore Impey thought, though I am not intirely of the same opinion; that the Action should be discouraged, and that there should be Judgment for Fifty Rupees only, by which the Plaintiff would be a loser by having brought the Action.
